1. Introduction

1.1.This Privacy Policy (hereinafter the "Privacy Policy") applies to the use of the User's personal data, as described below, by the Website published at www.pergament.io  (hereinafter, the "Site" or "Service"), belonging to Gesof-Med SRL (hereinafter, "Company").

The mere access to the Site confers the status of Company's services user (hereinafter referred to as "User"or "Users") and expresses full and unreserved acceptance of all and each of the terms of the Privacy Policy in the version published by the Company at the very moment the User accesses the Site or uses its Service. Consequently, the Privacy Policy will constitute a valid and binding agreement between the User and Company in relation to privacy. Likewise, the use of the Service expresses the full and unreserved acceptance of the User of the Terms and Conditions of Use of the Service (hereinafter, the "Terms and Conditions ") published at https://pergament.io/en/tos , which are complemented by the Privacy Policy.

 

1.3. The purpose of the Privacy Policy is to inform the owners of the Personal Data, as defined below, regarding whom information is being collected, the specific processing of their data, the purposes of the processing, the data of contact to exercise the rights that assist you, the periods of conservation of the information and the security measures among other things.

Once the relationship between the Parties has ended, for whatever reason, the Company reserves the right to keep the information until the end of its treatment. Any person who has provided personal contact information through the Site may send an email to contact@pergament.io in order to update, delete and/or correct their personal contact information. The Company will respond to the request within two business days after receiving it via email.

 

5.7. The Site may contain links to other Internet sites that are not owned by the Company. Consequently, the Company will not be responsible for the actions of those internet sites, to which this Privacy Policy will not apply. 6. Assignment And Transfer Of Personal Data. 

6.1. Only to comply with the purposes established in this Privacy Policy and for the purpose of providing the Service, the Company may disclose the Personal Data and/or personal information of the User, when necessary, to the authorities, Company's partners and other third parties, such as third party service providers used in connection with the Service, for example to perform marketing, advertising, communication, infrastructure and IT services, to personalize and improve our Service, to process credit card transactions or other methods of payment. 7. Confidentiality And Security Of Information.

7.1. The Company has adopted reasonable security measures to protect Users' information and prevent unauthorized access to their data or any unauthorized modification, disclosure or destruction thereof. The information collected by the Company will be kept strictly confidential. Access to personal data is restricted to the Company's employees, contractors, operators, and representatives who need to know such data to perform their duties and develop or improve our Service. The Company demands the same standards of confidentiality from its suppliers. The Company does not allow access to this information to third parties except at the express request of the User.

Notwithstanding the foregoing, considering that the Internet is an open system, with public access, the Company cannot guarantee that unauthorized third parties may not eventually overcome security measures and use User information improperly. 8. Changes In The Corporate Structure.

8.1.  The Company reserves the right to transfer the information collected in the event of a sale or merger of the Company, or an acquisition of the main assets of the Company, or any other kind of transfer of the Company to another entity. In this case, the Company must adopt reasonable measures to ensure that said information is used in a manner consistent with the Privacy Policy.

 

9. Minors

9.1. Although the Site and/or Service are not aimed at minors, in the event that a minor has access to them, their use must be supervised by their parents, guardians or legal guardians. The Site and/or Service are allowed only for those who are of legal age to contract and are not legally inhibited or in any way prohibited from exercising legal acts, rights and/or obligations. 10 . Rights Of Users Regarding Information.

a) For these purposes, the User must send their Request by sending an email with the subject "Access to Personal Data" to office@pergament.io . The Company may require said User to identify himself, which may be verified by the Company, as well as specifying the Personal Data to which you wish to access, rectify or remove.

 

b) The Company may reject the processing of Requests that are unreasonably repetitive or systematic, that require a disproportionate technical effort, that endanger the privacy of other Users, or that are considered impractical, or for which it is not necessary access to Personal Data.

 

c) The service of access, rectification and removal of Personal Data will be provided by the Company free of charge, except in the event that it requires a disproportionate or unreasonable effort, in which case an administration fee may be charged.

 

10.2. Likewise, the User authorizes the Company to use their Personal Data to send communications and advertising materials (such as newsletters and brochures) referring to the activities of the Company and/or that at the sole discretion of the latter could become of interest   to users. Users may request at any time the suspension of such shipments.

FURTHERMORE, AND IN ANY EVENT, THE USER IS INFORMED THAT AS THE HOLDER OF THEIR PERSONAL DATA, THEY HAVE THE AUTHORITY TO EXERCISE THE RIGHT OF ACCESS TO THEM FOR FREE AT INTERVALS NOT LESS THAN SIX MONTHS, UNLESS A LEGITIMATE INTEREST IS ACCREDITED. THE ENFORCEMENT AUTHORITY HAS THE DUTY TO ASSIST THE COMPLAINTS AND CLAIMS THAT ARE SUBMITTED IN RELATION TO NON-COMPLIANCE WITH THE RULES OF PROTECTION OF PERSONAL DATA.

 

10.5. With regard to Users who are citizens of the European Union, they may exercise the following rights against the Company:

 

  • Access rights. You have the right to access your information to know what Personal Data we are dealing with in particular.   

  • Rectification of data. You have the right to rectify inaccurate Personal Data that we are processing.

  • Opposition. In certain circumstances, and for reasons related to your particular situation, you have the right to object to our processing of your Personal Data, in which case we will keep it blocked for the period described above.   

  • Limitation of treatment. You have the right to request the limitation of the processing of your Personal Data to those specific purposes that you wish.   

  • Portability. You have the right to receive those Personal Data that you have provided us, in a structured format, for common use and mechanical reading, and that we transmit them to another person responsible for the treatment other than the Company. 

  • Complaint. You have the right to lodge a complaint with your data processing authority if you believe that your rights have been violated.

  • Judicial remedy. You have the right to exercise an effective judicial remedy against a legally binding decision of a supervisory authority;

  • Notification. You have the right to be notified by the Company regarding the processing of your personal data.

 

To exercise any of them, you must proceed to send an email to the Company at the address office@pergament.io in which you attach a copy of your identity document or Passport.

 

If deemed appropriate, the User can also file a claim with the corresponding control authority.

 

11. Exceptions

11.1. Notwithstanding any other provision to the contrary in the Privacy Policy, the Company may disclose certain personal information of Users, when it believes in good faith that such disclosure is reasonably necessary to:

 

  1. Avoid legal liability;

  2. To comply with a legal requirement, such as a search warrant, subpoena, or court order;

  3. To comply with a requirement of a government or regulatory authority; 

  4. Protect the rights, property or security of the Company, of the Users, or of a third party.

 

12. Ethics Line / Complaints Line

12.1. The Company offers the User a communication channel to publicize anonymously, confidentially and safely the existence of ethical irregularities by any member belonging to the Company (hereinafter, the " Communication Channel "). The Company carries out all the necessary measures so that said irregularities do not occur, and for this reason makes available the Communication Channel detailed below so that the User collaborates with said purpose. For greater detail, we highlight below some examples of irregularities in an expository manner, so that the User is kept informed:

 

  1. Economic-financial fraud.

  2. Delivery of confidential company information.

  3. Conflict of interests.

  4. Carelessness or inappropriate use of the organization's assets.

  5. Inappropriate use of company name, logo and trademarks.

  6. Workplace harassment or mistreatment.

 

In the event that the User contemplates an irregularity of those mentioned, he should not hesitate to report it. Your report will be treated quickly, confidentially and professionally.

 

13. Modification Of The Privacy Policy. 

13.1. The Company may modify the Privacy Policy at any time. The new versions of the Privacy Policy will be notified by publishing said new version at https://pergament.io/en/privacy-policy and notified by the contact channels that the User declares in his case.

 

13.2. The User accepts that he will be notified of any modification to the Privacy Policy once The Company had published them at https://pergament.io/en/privacy-policy, and sent the notification through the channels of contact declared by the User. The approval of said new version, and that the User's continuation in the use of the Service once said new version has been published will be considered as acceptance of said modifications to the Privacy Policy. Notwithstanding the foregoing, the User agrees to check the web page periodically.

15. Applicable Legislation And Jurisdiction 

These terms and any dispute concerning the implementation, interpretation and validity of this agreement are subject to the law, the jurisdiction of the state and to the exclusive jurisdiction of the courts where the Company has their registered offices. An exception to this rule applies in cases, where the law provides a sole place of jurisdiction for consumers.
